Terms & Conditions of Service

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https://tgif.network website (the "Service") operated by TGIF Network ("us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

TGIF Network strives to provide the best possible service to all our users, but we will not tolerate any unlawful activity or abuse on our servers. We respect freedom of speech and expression unless it is harmful to others. These brief guidelines are imposed to protect you, other TGIF Network members and us against such harm.

Registration Account Cancellation

You may remove your Registration account at any time. To cancel your Registration account, please contact TGIF Support at support@tgif.network. It is the Users’ responsibility to secure email confirmation from TGIF Network that account has been Removed. If the User has not yet received email confirmation of account removal, then the account remains active until such time.

No warranties

This Website is provided “as is,” with all faults, and TGIF Network expresses no representations or warranties, of any kind related to this Website or the materials contained on this Website.

Indemnification Policy

TGIF Network, presented on this site, is a non-commercial solution for amateur radio use only and only licensed amateurs should transmit on the network. You agree to use all TGIF Network services and website facilities at your own risk. TGIF Network specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall TGIF Network be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Users agrees that it shall defend, indemnify, save and hold TGIF Network harmless from all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against TGIF Network, its admins, developer's its users, that may arise or result from any service provided or performed or agreed to be performed or any service by TGIF Network, its admins, developer's, or assigns. Users agrees to defend, indemnify and hold harmless TGIF Network against liabilities arising out of:

  1. any injury to person or property caused by any Service in connection with TGIF Network's server;
  2. any material supplied owned by user's infringing or allegedly infringing on the proprietary rights of a third party;
  3. copyright infringement and
  4. any defective products sold to user,s of TGIF Network's servers.

TGIF Network shall be the sole judge of what violates this Policy.

TGIF Network reserves the right to monitor any and all communications through or with our facilities. You agree that TGIF Network is not considered a "secure communications medium" for the purposes of the ECPA, and that no expectation of privacy is afforded.

Archival of Records and Correspondence

All records and correspondence TGIF Network and your organization is carefully archived for the purpose of collaboration, reference, and confirmation. This includes written correspondence, such as e-mail and all messages sent through your user dashboard, control, confirmation, Upon signing up for service, you are consenting to this policy and authorize TGIF Network and its representatives to record and maintain your records during the course of your service and up to ten (10) years after cancellation of all services. TGIF Network may at its discretion choose to discard any records at any time after the cancellation of the services related to those records.

SPAM Policy

TGIF Network is committed to a zero-tolerance, anti-Spamming policy. Under this policy, we prohibit Spam, or any unsolicited commercial email, from being sent either: Over the TGIF Network network, by users or any other users of the TGIF Network network (including users' users); AND/OR over ANY network- if the message sent advertises or mentions a site hosted on the TGIF Network server.

We react quickly and seriously to violations, and we further reserve the right to terminate the services, without prior notice, of any user disregarding this policy. Sending unsolicited commercial email (a.k.a. "spam"), cross-posting messages to a large number of USENET groups, posting obscene or threatening messages while using or referring to a TGIF Network email address or web site URL is prohibited. The use of TGIF Network servers as a mail drop for responses to activities described above is also prohibited.

All e-mail sent through our service must adhere to the following general guidelines, regardless of liberties granted by your ISP or current SPAM legislations:

  • All recipients of any mass e-mail sent must have previously requested e-mail correspondence from your organization. They must also be aware of the type of information you will be sending and the frequency of your correspondance.
  • All mass e-mail communication must have a clear statement within the email outlining exactly how the recipients were added to the e-mail list used for the mass e-mail campaign.
  • All mass e-mail communication must have a clear removal/unsubscribe statement outlining exactly how a recipient may remove themselves from future mass e-mail campaigns.
  • All mass e-mail communication must contain the physical mailing address of the organization conducting the mass e-mail.

Content Policy

All services provided by TGIF Network may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless TGIF Network from any claims resulting from the use of the service which damages the subscriber or any other party.

TGIF Network always retains ownership of any server-side and user-side programming that is implemented for all user's using our platform, even if a fee was paid to perform the modifications to our platform.

In the event of account suspension, TGIF Network is not responsible for supplying or retaining copies of any text, images, logos, or data owned by the user.

It is the sole responsibility of TGIF Network user's to obtain and/or verify licensing for all images and graphics used on their talkgroup profiles and websites, even if the images were provided by the TGIF Network production staff. TGIF Network reserves the right to use legitimate royalty-free images from any source to deliver designs, revisions, or concepts. If preview images are used from stock photo agencies, the user is still responsible for obtaining and/or verifying the licensing for each photo and/or graphic. TGIF Network does not assume responsibility nor liability for trademark infringement fees assessed for violation of image licensing by our user's. Additionally, work performed for user's using unlicensed images and photos does not imply participation in the act of trademark infringement. We assume that any user-provided or user-approved images are legitimately licensed by the time the user uses the images publically.

Pornography and sex-related merchandising is prohibited on all TGIF Network servers. This includes sites that may infer sexual content, or links to adult content elsewhere. TGIF Network will be the sole arbiter in determining violations of this provision.

TGIF Network also prohibits the use of images or media that contain sexually explicit content, nudity, implied nudity showing covered areas in view, sexually suggestive content, profanity, or racist rhetoric. TGIF Network will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to TGIF Network servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

  • Pirated software
  • Hacker programs or archives
  • Warez sites
  • IRC Eggdrops
  • Proxy Servers
  • NPH-Proxy
  • The Anonymizer
  • Any Soap Mailers
  • Matt's formmail.pl (version 1.9S and above is ok)

TGIF Network does not host sites of or web pages promoting other website sites.

Any illegal activity, including adult content, links to adult content web sites, spamming or hacking will result in your site being shut down and all your files deleted without warning. No refund, even for pre-paid service, is given in this case.

TGIF Network will be the sole arbiter as to what constitutes a violation of this provision.

Email Policy

TGIF Network may not be the source, intermediary, or destination address involved in the transmission of any unsolicited email, email bombs, hate email, or any mass email. Your email account may not be referenced as originator, intermediary, or reply-to address of such email. "Safe-lists" are also strictly forbidden.

Scripting Policy

Each account comes with the entire suite of TGIF Network Platform features. You may not upload or install any CGI, ASP, or PHP scripts. Custom programming services are available through TGIF Network.

Traffic Policy

We reserve the right to refuse service to anyone for any reason not prohibited by law. Also we reserve the right to terminate service to any user for any reason not prohibited by law.

Any deliberate attempt to cause damage to TGIF Network or any other Internet servers will result in immediate account deactivation without prior notice. No refund, even for pre-paid service, is given in this case.

Technical Support

We provide technical support as free service and ran by volunteers. Your first port of call would be the help menu for FAQ and help documents and Videos on the site.

TGIF Network Main Support

Support is only provided via our email support system as an resource for our registered user's or thoses trying to register and is limited to Registration of Accounts,Talkgroup Registration, and hotspot security keys. However,TGIF Network reserves the right to refuse support to any user who overutilizes ,abuse, our resources as this is a free service so please respect it. Critical incidents are defined as outages or software errors and are normaly displayed on the announcement section of the site. Support has been able to reply within a 24-hours period, but donot hold this as a policy, so some replies can take longer.

Talkgroup Support

this will be your talkgroup trustee, or sysops, infomation can found on there talkgroup profile pages of how to reach them, these can help with hotspot setup, and how to connect to there talkgroups.

Backups

Full backups are made weekly, and backups of new/changed web data made daily. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for web server restoration purposes only. It is the user's responsibility to maintain local copies of their web content or any other information. If loss of data occurs due to an error of TGIF Network, we will attempt to recover the data for user. If data loss occurs due to negligence of user in securing their account or by an action of the user, TGIF Network will attempt to recover the data from the most recent archive. We do not back up e-mail data stored.

TGIF Network reserves the right to amend our Terms and Conditions at any time and without notice.

Responsibilities and Status of the Talkgroups and Trustee.

define Talkgroup: a group of people (users/subscribers) utilize one single TGID for voice communications, hence Talkgroup.

define what a “Talkgroup Trustee” is: The Talkgroup Trustee is the licensee of talkgroup or Talkgroups's they requested and that are assigned to them as the licensee. It is the licensee, and them alone, who is ultimately responsible for operating and maintaining the talkgroups under there care and to adhere to there Mandatory Licensing Conditions.

The Talkgroup Trustee may recruit the assistance of other people to be named as talkgroup sysops, but the legal responsibility for all matters pertaining to the Talkgroup rests with the Talkgroup Trustee and them alone.

If there are any terms that you do not agree with, please discontinue use of our Services` immediately.

TGIF Network Audio

What data is retained?

participants transmit personal data over amateur radio frequencies. An identifying callsign is mandatory, and a name and approximate location is normally transmitted. Other personal data may be disclosed by participants.

How is the data held?

An audio recording of TGIF Network is maintained as an unencrypted audio mp3 file held securely by the Data Controller

Justification for retention?

Due to disputes, it maybe necessary to keep copies of transmitted audio for the protection of members who may need to refer to content. Recorded audio has proven useful for identifying breaches of amateur radio licence conditions and the Contacts made over radio are deemed to be public domain and recordings are held under the GDPR ‘legitimate interest’ classification. An announcement (for general reception) about this is transmitted during each “net”.

Data sharing:

Audio as transmitted over amateur radio is deemed as “public domain” for general reception and where appropriate, audio recordings may be shared with third-parties.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
